High Court Bars Miles Sampa from Interfering with PF Records

IN a twist to the ongoing legal battle, the Lusaka High Court has ordered Patriotic Front (PF) Matero Member of Parliament Miles Sampa not to interfere with party records that show Morgan Ng’ona as the party secretary general.
This development comes barely 24 hours after the Court of Appeal dismissed an interim application in which Mr Ng’ona sought to stop Mr Sampa from interfering with party records.
Earlier yesterday, the Court of Appeal threw out Mr Ng’ona’s matter where he had obtained an injunction restraining Mr Sampa from removing him as secretary general. The court held that the case was wrongly before it.
After that ruling, Mr Sampa and his PF faction burst into celebrations, claiming he was back in control of the former governing party.
But later in the evening, the High Court issued a fresh order stopping Mr Sampa from interfering with Mr Ng’ona’s role as PF secretary general.
The order further prevents him from making any changes to the party’s official records at the Registrar of Societies.
In the ruling on the interim injunction, Judge Conceptor Zulu ordered that Mr Sampa, whether by himself or through his agents, is restrained from interfering with Mr Ng’ona’s functions. This is pending the hearing and determination of the matter before the court.
Mr Sampa has also been barred from making any representations to alter the PF’s official records relating to office bearers. Failure to comply could result in serious consequences.
“Take notice that in the event that you… elect to disobey this order you shall be cited for contempt and committed to prison for breach of this order,” read part of the penal notice.
“It is hereby ordered that the Defendant… is restrained from making any representation whatsoever aimed at altering the official records of the Patriotic Front Party,” the court directed.
The court set May 13 for the inter-parte hearing.
